Disclaimer

The advice, recommendations, and discussions I provide are for informational purposes only. I am not a licensed consultant, therapist, or certified professional in mental health, physical training, or related fields. Any insights I share are based on personal experience and general knowledge, not professional certification. It is the sole responsibility of the parent or guardian to determine whether further help from licensed professionals is necessary. I am not liable for any outcomes, including but not limited to reduced playing time, loss of positions, quitting the sport, injury related to players working out outside of our training sessions, or any changes in mental or physical well-being. By engaging with my guidance, you agree to hold me harmless in all respects.

Terms & Conditions

CONFIDENTIALITY:

All information and recommendations shared during our sessions are completely confidential. I will not share any information with another parent, player, coach, or individual unless specifically directed by the parent.

 

Session Recordings:

All sessions will be recorded with the express consent of the parent. These recordings may be used for historical purposes and as legal protection concerning matters discussed. These recordings may be made available to the requesting parent; however, they otherwise remain under the confidentiality terms of this disclaimer.
 

Code of Conduct:

Clients agree to maintain respectful, professional behavior during all sessions. Any disruptive or inappropriate conduct may lead to termination of services.

Intellectual Property:

Any materials, training plans, or content provided by the coach remain the property of the coach. Clients may not reproduce, share, or sell these materials without express permission.

Data Privacy:

Personal information provided by clients will be stored securely and used only to deliver services. Information will not be shared with third parties without consent, except as required by law.

Liability for Virtual Sessions:

While I strive to ensure smooth virtual sessions, I am not liable for issues caused by internet outages, platform interruptions, or technical difficulties beyond my control.

Refunds:

Refunds are only provided if a session is canceled by the coach or if a client cancels within the agreed cancellation policy.

Termination:

I reserve the right to terminate services if terms are breached or if continued sessions are deemed unproductive. Clients will be notified of termination and any applicable refunds.

Communication Policy:

I aim to respond to messages within 48 hours. Official communication will occur via email or text, depending on what information is provided by the client.

Disputes:

Any dispute shall be resolved by mediation first. If mediation fails, disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its rules.

Cancellation and Refund:

  • Cancellations must be made at least 24 hours in advance to reschedule without penalty.

  • Cancellations within 24 hours are allowed one reschedule per month; multiple or consecutive late cancellations will result in the session being forfeited.

  • No-shows result in a forfeited session with no refund or reschedule.

  • Sessions expire 6 months from the date of purchase unless otherwise noted in the package description.

  • Sessions do not need to occur in consecutive weeks (e.g., bi-weekly or monthly scheduling is acceptable), though more frequent sessions typically lead to better results.

Virtual Session:

  • All virtual sessions are conducted via phone or virtually, at the client’s discretion.

  • Preferred virtual platforms include FaceTime, Zoom, and Microsoft Teams; other platforms must be arranged by the client, with an invitation sent in advance.

  • Session times are rounded to the nearest 15 minutes (e.g., a 35-minute session is billed as 30 minutes).

  • Sessions interrupted by technical or connectivity issues will be rescheduled if not resolved within 5 minutes; rescheduled sessions must occur within 5 days of the original session.

In-Person Training:

All sessions are conducted at public locations, such as local high school fields, which I do not own, manage, or control. By signing up, clients acknowledge that the use of these public spaces may be subject to availability and external conditions beyond my control.
 

Media Release and Authorization for Use of Likeness (Including Minors):

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the client, and/or the undersigned parent or legal guardian of the client (if the client is under the age of eighteen (18)), hereby irrevocably grants, assigns, and conveys to the coach, and the coach’s successors, assigns, licensees, and representatives, the unrestricted, perpetual, worldwide, transferable, and royalty-free right and license to photograph, record, reproduce, publish, display, perform, transmit, edit, and otherwise use the client’s name, image, likeness, voice, statements, testimonials, and any audio, video, or photographic recordings (collectively, the “Materials”).

 

Such Materials may be used in any and all media now known or hereafter developed, including but not limited to social media platforms, websites, advertisements, marketing campaigns, promotional materials, and other commercial or non-commercial purposes related to the coach’s business.

 

For Minor Participants:

The undersigned parent or legal guardian represents and warrants that they are the lawful parent or guardian of the minor client and have full legal authority to execute this agreement on the minor’s behalf. The parent or guardian hereby consents to the minor’s participation and agrees to all terms contained herein on behalf of the minor. The parent or guardian further agrees that this release is binding upon both the minor and the parent/guardian, including their respective heirs, legal representatives, and assigns.

 

The client and/or parent/guardian acknowledges and agrees that:

  1. The coach shall have sole discretion in the selection, editing, and use of the Materials;

  2. The client and/or parent/guardian waives any right to inspect or approve the final use of the Materials;

  3. The client and/or parent/guardian waives any and all claims, demands, or causes of action arising out of or in connection with the use of the Materials, including but not limited to claims for invasion of privacy, right of publicity, defamation, or misappropriation;

  4. The client and/or parent/guardian is not entitled to any compensation, fees, royalties, or other remuneration of any kind arising from or related to the use of the Materials.

 

The client and/or parent/guardian further represents and warrants that they have full legal authority to grant this release and that this agreement is binding upon their heirs, legal representatives, and assigns.
